The Curtis Forbes Case
Undisputed Facts:
1. Sometime between the early evening of March 10, 1980 and the early morning of the 11th, 18 year old, Marilyn McIntyre was murdered in her Wisconsin home.
2. Marilyn's 3 month old son, Christopher, was not harmed.
3. Marilyn's husband, Lane, worked third shift from 11pm to 7 am.
4. The knife used to stab Marilyn was one that was already in the home.
5. When Lane first spoke to police he mentioned the name of Curtis Forbes, a long time friend.
6. Curtis Forbes went to the home of his girlfriend's parents' home sometime during the night.
7. After the murder Curtis Forbes left the area for some time writing his girlfriend, Debra, that there was a lot of "heat" on him with circumstantial evidence. He returned after a few weeks.
8. In 2009 Curtis Forbes was arrested for the murder of Marilyn partially based on a DNA match that was later thrown out of court and not allowed at trial.
9. November 2010 Curtis Forbes was found guilty of murder.
10. February 2011 Curtis Forbes is sentenced to live in prison. He is eligible for parole in 2020. He was also required to sign the sex registry list despite not being found guilty of sexual assault due to the statute of limitations have run.
11. July 2011 the courts deny Forbes' request for a new trial.

The amount was minute and results were not conclusive. What they found is that the drop of blood was consistent with Forbes' but there was a chance of 1 in 89 that someone else could have contributed this. Investigators argued that many people were tested and of them all, Forbes was the only one who matched at all. The courts found these "odds" not to be conclusive enough and did not allow this evidence in trial.
2. Just prior to the murder Forbes and his girlfriend Debra had split up. Lane has stated that Marilyn informed him that Debra had told her the split was due to the fact that Forbes was abusive. Debra has denied this claim.
3. Debra was interviewed just after the murder and stated that Forbes did show up at her house. She has repeatedly changed her story on the time, as well as the condition he was in. Sometimes she states he showed up at 2 am and other times she says 4 am. She also tends to get amnesia when it comes to what Forbes was wearing when he got there. She had reported to more than a few people that when he showed up at her door his shirt was covered in blood. She would never admit that to the police. When confronted with the fact that others had said she did say that, just as she was confronted with telling Marilyn McIntyre that Forbes abused her, these people are lying about her commenting on the shirt. In 2009 she relented to she was "sure." Then later after Forbes was arrested a telephone conversation was recorded between her and Forbes where she asked him about his bloody shirt that night. Forbes did not deny having blood on his shirt and she was asking as if she remembered it. Then when she was brought into court for the trial (by this time she and Forbes had been married nearly 30 years) she claimed she was tricked by the police to admit things that were not true.
4. As in many cases there were witnesses who claimed to have heard Forbes confess. One was a jail inmate; another was someone who had supposedly overheard a conversation between Forbes and his son. Forbes denies all of these based on his claims of innocence.
My Opinion:
This is a pretty rare case. Not only was it a cold, nearly 30 year old case, but it was also all based on circumstantial evidence. There was no direct evidence. No one saw Forbes at the scene and aside from the speck of blood, that wasn't certain and wasn't allowed in the trial, there seemed no physical evidence.
The defense tried to say that Lane McIntyre had killed his wife before going to work. There are a few problems with that. First, is his actions at work. No-one reported him behaving strangely. Secondly, a neighbor was awakened by the McIntyre dog around 3 am. When you add this to a friend who had driven by at 12:30 am and saw no lights and then again around 3:15 and saw the porch light on and the dog outside it indicates that Marilyn was up and awake sometime between 12:30 and 3:15, all times while Lane was at work.
Without any leads Lane was under the police suspicion for quite some time seeing as he was the husband and it was he who found his wife the next morning. One of Marilyn's sisters had not cared for Lane and after the murder she suspected him. One of the reasons was she felt that he had remarried too soon. Lane had not told Christopher about his biological mother for many years and after he did tell him their relationship changed. Christopher himself has said that their estrangement had a lot to do with the suspicion that fell on Lane.
I believe that Curtis Forbes is guilty. However, this is one of those cases that I have no idea how they convicted him. There was no physical evidence.... at least in a legal sense for the jury to see. All that can be proven per se is that Marilyn McIntyre died sometime after 12:30am and after her husband had gone to work and sometime before 7 am (if you believe Lane to be innocent) when he found her. They had witnesses who claimed his wife (then girlfriend) said he showed up at her house around 4:00 with his shirt covered in blood, something she denies telling people. They had the letter that he sent to his wife when he took off after the murder. And... well... that's just about it. That is unless you count the jail inmate who said he confessed and the person who said they overheard a conversation. Forbes never got in any other legal trouble in the subsequent 27 years between the murder and his arrest, at least none that they know of. An appeal has been made already and the conviction has been upheld but this is a case in which I would not be surprised to see overturned.

I used the fact the Hennis was never in any further trouble after his release as character evidence, and you still believe he is guilty-lol. I would like to hear more of why you believe Forbes to be guilty, because I dont see what they have on him at all...

ReplyDeleteI don't know... when it comes to this case it's feeling based on his actions. Of course I have said many times my feelings and what you can prove are different. I had seen a show on it before and just saw another this morning reminding me of the case (hell, it may have been the same show, who knows I watch so many). His wife is what really convicted him to be honest... in court and I guess in my opinion. She has done so much to made excuses and deny things and then change stories when confront you just know he showed up to visit here at 4:00 in the morning covered in blood. Now of course since she gets to be wishy washy and deny off and on the bloody clothes she's never been asked if she asked him WHY there was blood all over him. On the jailhouse call where she mentions it to him she says something like "What about the bloody shirt?" and he says "I'll explain that" but refuses to do so on the phone. You just can't tell me she didn't ask him when he showed up what the hell was going on. You add this to the fact that he took off after the murder saying there was heat on him and a lot of circumstantial evidence. It was noted that yes, the husband mentioned his name, but they had nothing on him so where he came up with they had stuff on him at that time has been questioned (that was in writing).
Other than that... I don't know... I just feel he really is guilty.

ReplyDeleteThe theory that was given out about WHY he would have done this goes like this. Lane McIntyre says that Marilyn told him that Debra (Forbes girlfriend, later wife) had told her that Forbes was abusive. One week before the murder Debra and Forbes had split up. Theory is that Forbes was convinced that Marilyn (the two couples were all friends) told Debra to leave him, to which she did and Forbes blamed Marilyn.
You have to remember though that Debra claims she never told Marilyn this. Then again Debra claims anything anyone ever said she said was a lie.
Well, it doesnt make sense that he was on the prowl for sex from an ex-girlfriend, and when refused, decided to instead kill the one "responsible" for breaking up his marriage.... If he was looking for another woman, I am sure he- at least in his mind- considered himself for the moment to be better off without his wife...
ReplyDeleteIf you switch to the theory that, like Hennis, he was on the prowl for sex and-when denied- turned violent at the next stop, then I think you REALLY have a problem. He didnt like her enough to pursue her, especially if she was reporting back to his wife!
I just dont think there is much on him. He may have been a creep, but lots of people are...

Delete@Susan You want to know why Debra was wishy-washy? Because she's an abuse victim who's had her thoughts warped for the past 30 years! Look at what he did to Marilyn, what do you think LIVING with him was like? I am so sick of seeing her being portrayed as this evil woman - she is a victim, too. It is common knowledge that he abused both her and their two children and was a huge drug user his entire life. Why do you think the daughter changed her last name and got the hell out of there? Why do you think the son is exactly like his father? (The son's wife is a real piece of work, too!) Curtis was never arrested for any later charges but carried a vehement hatred for any and all law authority throughout his life, as well as an inexplicable paranoia and repeated grandiose plans to 'escape' to a remote island or location and live 'simply and safe' - not the behavior of an innocent man, lol!
As for Debra lying to anyone, she was interrogated for eight hours straight in her own kitchen, unable to call her lawyer or anyone. (At one point a family friend stopped over and was forced to leave after he started questioning what they were doing to her.) They were putting words into her mouth and forcing her to say whatever they wanted her to say, whether it was in context or not. Why do you think she attempted to file that her rights were violated?
The marriage was not even related to the murder, it was about her Christian parents forcing them to get married because she got pregnant. She is a naive, innocent woman who happened to get knocked up by and forced to marry an abusive murderer. Let's see how you would be after 30 years! I don't imagine you would be able to get a grasp on reality very easily at all. (And yes, many times she attempted to leave him via PAVE, but every time he would plead and beg her to come back, saying he had changed. LIES! Hardly any woman in this situation ever gets out.)
Oh, and also -- all of those 'witnesses' have either deals in place with Colombia County (one of the most corrupt and crooked counties in Wisconsin) and/or HUGE personal grudges/vendettas against Curt, their son, and Debra (Her father gave her half-brother very minimal in his will due to not being his biological son among other well-known reasons).
Wanna hear some more that was not presented at trial. Deb was pregnant at the time that this crime happened. She had the baby prematurely, naming the baby Elisa, and the baby died, if memory serves, about 6 weeks later. The person Lane married (whom they passed off to Christopher as his mother) was Deb Forbes cousin. Also, Deb was no beaten down wimpy girl, she was very aggressive and outspoken.

ReplyDeleteWhen this case was reported on 48 Hours they posted some of the evidence the police collected. That included cigarette butts in an ashtray with Marilyn's DNA and Curtis Forbes' DNA. Marilyn kept a really clean house, so police knew the butts were left after Lane had left for work.
That puts Forbes in the house that night/early morning. He never admitted that to the police, so if it was an innocent drop-by he just should have told that to the police right away to help them with their timeline. Not telling them implies his guilt.
.. I personally feel that Lane is the guilty party. After all, he was, acording to several police reports the abusive one, example, dragging her out of a party they were attending, by her hair, holding her off the ground by her throat, knocking her down in a gravel driveway and acording to eye witnesses in this particular police report, as she crawled away on her hands and knees, kicked her in the crotch. this left bruising on her knees and when asked in court if he knew of any bruising on her knees he denied it. How could a caring husband have missed that? And yes what I have just told you, all documented by witnesses in 3 different police ...reports, Showing he had no respect for her at all.In another police report, a witness tells of Lane bragging that he could get away with murder. And stiil yet another police report from a former girl friend of Lanes, stating his abuse to her and announcing that if they ever found her dead they shgould know that Lane did it. When Marylins oldest sister first heard of her demise, her first words were - Lane did it, I suppose from knowing first hand of the abuse.Another thing that strikes me as weird is the fact that when Lane first had arrived home he said that the dog was on the front porch abd cowering, do you suppose that the dog had also been beaten by Lane at previous times and when Marylin was beaten and killed by Lane that the dog did not know that the incident was over or if Lane was going to be continually abusive to him. Oh , did I mention the fact that three days before the murder Lane had taken out a l0,000.00 dollar life insurance policy out on , of all people, not himself, so that if something happened to him, his new wife and 3 month old baby would be taken care of, but om Marylin. and when asked in court how long it took him to drive the 7 blocks from work to his apartment he answered 15 minutes, Which curts lawyers drove,in traffic during the day in 3 minutes and one of curts brothers had actually foun a way to get there with no stop signs at night in 1 minute. so I say that was one of the many lies and deciets coming from Lane . I believe Lane had killed Marylin on the evening of the l0th of march, just as he had it put on her tombstone,before he left for work as he had to be there at ll o clock , If he had truly believed that curt had done it in the wee morning hours of the llth wouldnt he have put that on the tombstone instead? When investigators first asked Lane who could have killed marylin he readily announced curt forbes, Ive often wondered how he knew that or he just needed to throw the sent off his tail. I also know that according to police reports that the lights on at Lanes apartment at 3 oclock coincides whth Lanes break time and do you suppose that he may have slipped out the back, l minute later, home, to do what? FEED the 3 month old baby. Or do you suppose curt fed the baby that night ,and after doing the dasteredly deed went back and fed the baby?

DeleteI believe curtis forbes to be innocent because there was no dna evidence as attested to, in court, under oath, by state forensic labs anylist Karen Daily , who testified that they could not put curtis forbes at the home or prove he commited the crime by dna evidence. I also believe curtis forbes was framed by detectives and in my opinion railroaded by the DA-s office, with the help of even his own attornies, who made him look guilty by their actions in court! After all the attornies had at that time 7 different murder cases that they were working on so where they got time to do a good job is beyond me. Most of the forbes family was sequestered and in court when no one was seated behind forbes the da announced as he pointed out the emptyness ,Forbes has a very large family, what a circus! The DNA evidence became public knowledge only after Marylins exhumation, when no evidence was found detectives anounced that they arrested Curt forbes based on Dna evidence, as they were ready to frame him! you are right about the knife comming from the home! What I would like to know is why the DA fought so hard to keep it out of court? Certainly if it had Curt Forbes finger prints on it it would have been exibited in his trial. according to police reports there were two different types of female blood mixed with marylins blood spatter on the wall. Also whomever stabbed marylin according to the spatter evidence was left handed! Curt forbes is right handed, as Lane is left handed! Another item I find most peculiar is a witness who reported seeing lights on at three o clock in the morning,stated in a police report that the reason he was at the scene is because he was looking for his wife, He drove by at midnight and no lights were on but at three oclock when the lights were on he stated he did not stop to see if she was there,even though his wife was Lanes sister. And I also believe that the black hair found on Marylins night gown was linked to him. I believe curts attornies were in on a railroad job because when asked about certain procedures and testimonies by curt forbes they respondedby saying that would be addressed at appeals even tho the trial was no where near to be over. How did they know the verdict long before there was one? I believe curt forbes civil rights were violated more than once! For example sitting in jail for 6 days before being charged, and I will add more later. Back to the knife. whose finger prints were on the drawer where it would have been kept? And whose finger prints were on the babies bottle that fed the baby that night? We will never know that as Lanes mother was allowed to take multiple bags of items from the crime scene! By the way is the second way they violated curt forbes civil rights! On the night of Marylins death Lanes neighbor from the next appartment claims in a police report to have heard loud noises as if they were having a fight! LANES response to that was " we allways were very boisterous",. As I know and anyone else will tell you he is actually a very softspoken individual. curt forbes cloths were confiscated by detectives and returned 2 weeks later, detectives announcing no evidence could be found! do you suppose that if evtdence had been found they would have arrested him at that time? Another violation took place, in my view, is knowingly convicting an innocent man, as the DA announced at the start of the trial, " this trial is not about justice but about getting a conviction" He even got to bring his own jury with him from Jefferson wisconsin, where his office is located, even after a jury had allready been selected from else where, as I stated, even curt forbes own attornies let this happen! Curt forbes arrest after thirty years made a giant media frenzy, in which the DA, and the detectives were basking in their career glory.

ReplyDeletedo you think they proved it?the state agrred that there was no blood on curt's clothes that is why ernie smith didnt send them to the crime lab aint that right ernie. tell them you fat lying bastard the stae agreed that there was no proof of blood or that is was marylin's. the prints on the knife were not curt's, that is why wamback and fat wayne pigsmith fought so hard to keep a murder weapon out of the trial., when was the last time you ever heard of the cops and the d.a. fight to keep a murder weapon out of a trial? the prints were not curts.wamback told the court that the crime lab cant tell the difference between blood and rust, we sure know how wamback feels about the crime lab and the job they do, because the crime lab said they can definitely tell the difference, any commant on that wamback? well it dont change the prints on the knife now does it.wamback told everyone that he had curts dna . let his home county jury read it in the paper that he promised a conviction on dna well it was not curts and the judge would not let him use the dna against curt, what a liar that wamback is, fess up ernie wayne and wamback you railroaded curt forbes without any evidence , the fact is wayne smith used to go and watch debby dance and has been a jealous cop his whole life, then he appoints himself to the murder and frames curt for it. it was 1;20 am when curt got to debby's mom and dads and the lying cops keep telling debby it was 5 after 4 , you people trying to make debby to be a liar, well the cops are the liars they sat there telling debby to ask curt on the phone about where did the blood on the shirt come from? debby never seen any blood nor did her mom and dad, the cops edit the tape to say what they wanted, aint that right? you think they solved this murder? lane sure forgot eveything in a hurry, if that was my wife and i didnt kill her i would remember evey detail and fight till the end to get it solved not let it go cold like lane did ,he wanted to forget the whole thing.the bloody shirt came right out of the lying cops and d.a. mouth.the brother in law's hair on her night gown and him claiming to have never been in the house is more evidence than they have on curt forbes.what about the other brother in law driving aroud looking for carolyn sees marylin's light on and dont stop, first he said he went by at midnight , lights were off then he says they were on at midnight and he didnt stop to see if carolyn was there, then he says he went by at 3 am the lights were off, then he says they were on,and he didnt stop, you tell me if you are looking for your wife and her twin sister's light is on that you don't stop and see if your wife is there? that is more evidence than they have on curt forbes.did you see the way lane used to beat the shit out of her,his actions before the murder were not allowed in court, that is more evidence than they have on curt forbes. they didnt have any evidence and railroaded curt forbes because of a lying jealous cop.

NO!! and the state even agrred to that!!!curt's laywers requested solitary confinement for curt because they didnt want any jailhouse snitches saying curt told them he did it. well 1 month later, come on forbes you are going to general population and i quote" IF WE HAVE TO DRAG YOU" well the two jailhouse snitches spent one night each in the cell with curt and both came out with the same story, the oldest lying cop trick in the book, we all know that.bednar claims that curt told him that he gave a friend's wife a ride home from the bar one night and she never needeed another ride. he changed his story 3 times but they all 3 said he told him about giving a friend's wife a ride home from the bar. was she at the bar? where is the babysitter? did she have the baby at the bar? that lie of bednars does not even have any truth to it or does it pertain to marylin but they used it against curt. last chance for a railroad it what it should have been called.

ReplyDeleteI actually had to go back and read this blog to refresh my memory on this case since it has cause so many questions and issued. I personally still stand by my original statement that I feel like he's guilty, but as I have often said before, what I feel and what can be proven are very different. Not to mention, just because I feel like he's guilty does not mean that I think they had enough evidence to convict him nor do I believe he got a fair trial.
ReplyDeleteCases like this scare me. I put this case in the lines of cases like Drew Peterson and Timothy Hennis (there are blogs on both cases here) where for one the evidence just simply does not seem to be there, at least from a conviction standard but also cases that the laws are bent to get the conviction. In Peterson's case a new "law" was made simply to get him and in Hennis' case they were able to retry him after he had been acquitted based on the fact he had been in the military. These cases are dangerous!! There always seems to be a gung ho detective or prosecutor who is so certain that they have the right suspect that fight for these 'new laws' to get their convictions and in the end those laws become prescience. When courts start allowing things in that previously would not be allowed simply for the sake of a particular defendant, every defendant after them can use that as case law and it puts every innocent person in jeopardy.
In this case in particular I do feel it was right to kick out the DNA if the facts that I have here are true. 1 in 89 is not close enough for me. They have said they checked everyone close to her and Forbes was the only one close.... AND??? As DNA progresses I think prosecutors have pushed the limits and relied on the saying "DNA." What I mean is that it now seems that any lawyer anywhere can go into a court room and say "We have DNA"... before you know it they won't have to show any results... just say they have DNA. And we all saw in the Casey Anthony trial how gullible juries are believing lies told by lawyers in a courtroom. While DNA has done a lot of good and brought justice to many families, as well as saved innocent people, it has been pushed to limits that in my opinion are too far!
i beleive it is 1 in 98000 not 1 in 89 get the facts, if you think curt forbes did this you dont know the real story or you are from wamback's home county (like the jury was) or related to one of the cops, which is it? why not use the murder weapon in a murder trial? not curt's prints!!! you show me one piece of evidenc against curt forbes. better yet show the world one piece of evidenc against curt forbes.nowhere in these papers we got does it mention the word evidence.. you tell me where you got your opinion from, that says curt forbes did this murder.. like the whole macintyre family and marylin's family thought lane macintyre killed her and when asked what changed thier minds they simply answered ,they have curt's dna. and no thet did not have his dna and the cops and wamback lied to the judges and the whole world that they had curt's dna , why? I heard the wife ask about the bloody shirt and he said I'll explain that but not on the phone. Do you have a law degree? I'm not from anywhere near there and I believe he did it he even acted guilty. I would like to reply to the comment that is in the second paragraph first line of my opinion, and beg to differ there as the police reports I have seen say that Lane was unusually friendly at the beginning of his shift and became more adgitated as the night drew on! so what are you doing publishing statements that you know nothing about? that is the same method of b.s. the cops used to get him convicted!

Why didn't anybody ask why in the world does her tombstone say May 10th??? I have never seen anyone known to have died in the early am have the day prior on their tombstone. If she was killed on May 11th, why doesn't her stone read May 11th??? Where is the murder weapon, I mean come on where is the knife??? All this dna crap, I'm afraid to lose a hair, god forbid they find a hair of mine on somebody who ends up dead and my life will end

You also did not reveal the convo the police recorded of them trapping her into saying yes he did have blood on his shirt!! She seems to forget everytime It's important tho. Given it scares the hell out of me what juries will prosecute you over now a days this guy is beyond guilty!! Do your homework!!!
ReplyDeleteDeb was pregnant at the time that this crime happened. She had the baby prematurely, naming the baby Elisha (I got the name wrong above), and the baby died, if memory serves, about 6 weeks later. The person Lane married (whom they passed off to Christopher as his mother) was Deb Forbes cousin. Also, Deb was no beaten down wimpy girl, she was very aggressive and outspoken.
